Review your estate plan after major life or financial changes, such as marriage, divorce, the birth or adoption of a child, a death in the family, relocation, retirement, a business sale, a substantial change in assets, or a change in health. It is also wise to conduct periodic reviews to ensure that beneficiary designations, powers of attorney, property titles, and trust funding remain consistent with your goals.

A properly created and funded living trust can allow assets titled in the trust to pass according to its terms without ordinary probate administration. However, simply signing a trust is not enough. Appropriate assets generally must be transferred to or coordinated with the trust. Assets outside the trust may still require probate unless another valid transfer method applies.

A will provides instructions for distributing probate property after death and may nominate a personal representative or guardians for minor children. A revocable living trust can hold property during the creator’s lifetime and provide instructions for management during incapacity and distribution after death.
